Elizabeth Arnold and Chester Hanvey discuss an appellate decision that says the time employees spend accessing their computers is compensable under federal wage laws.

Recently, the 9th Circuit issued an opinion that could impact whether time that call-center employees spend “booting up” their computers to perform work is compensable under the Fair Labor Standards Act. Some employers will reevaluate their compensation practices for hourly call-center employees and, possibly, for any hourly employees who boot up computers to clock in. The authors describe methods to measure the duration of computer boot-up time.
