The economics are crucial to collective actions, explained Mark Bosley during a BRG-hosted panel at London International Disputes Week. He said that “funding will remain central to which sectors take off and which ones don’t.” Without a clear route to damages, the UK “maybe won’t see an explosion of many types of ESG claim,” but he expected some cases to test the market, saying “we’ll find out what isn’t a competition case,” and there is interest in group actions on environmental issues to hold governments to account.
