Dr. Walter Vandaele is a managing director at BRG with expertise in antitrust economics, industrial organization, and econometric and statistical analyses.
He focuses his practice on competition and commercial damages valuation issues arising in antitrust, patent infringement, breach of contract, and other types of commercial disputes. He has submitted oral and written testimony in numerous federal and state courts, in mediation and arbitration matters, and in regulatory proceedings in the United States and abroad. He has consulted and testified most extensively on engagements involving the pharmaceutical and biotechnology industries but also has experience in numerous other industries, including telecommunications, computer software, uranium mining and enrichment, and plastics additives.
In his antitrust engagements, Dr. Vandaele has analyzed such issues as price bundling, loyalty rebates, exclusive dealing, prospective merger impacts, and average wholesale price drug reimbursement. In patent litigation, he has analyzed patent infringement damages, patent-related sources of a drug’s “commercial success,” and economic factors associated with preliminary injunctions.
