The Third European Forum on FDI Reviews and CFIUS delved into the critical changes affecting professionals working in foreign direct investment screening regulations.
On June 8, Steve Klemencic presented with Dr. Andrea Pomana on “Incorporating Mitigation Strategies Into Your Deal Structure: The Finer Points of Passing Clearance and Getting the Deal Done.” They reviewed thresholds and requirements, cross-border mergers and acquisitions (M&A) transactions, regulation schedules, insurance, and other special considerations that affect transactions.
On June 9, Mr. Klemencic joined Dr. Thomas S. Wilson, Jonathan Panikoff, and Alan Levesque to present “Managing the Interplay between CFIUS, UK and EU Member State Regimes: Critical Updates on FIRRMA, CFIUS Reviews and Mitigation Expectations.” The presentation evaluated Committee on Foreign Investment in the United States (CFIUS) requirements and how they translate in the European Union and United Kingdom. Presenters also discussed the crossover between FDI and other investment reviews; assessed the unique issues that come into play when a Chinese company acquires a European company with US subsidiaries; and examined the real-word impact of recent transaction reviews globally.
