Understanding Infrastructure Disputes
2021-2023
In this series, BRG infrastructure, construction, damages, and energy and resources experts set out the elements of infrastructure projects, which are key to understanding the disputes they frequently become involved in; and the context and insights that economists and forensic accountants will apply in their analysis and assessment of these cases.
Series 2, Risk
- “COVID-19 Effects on the Construction of Renewables Projects” (April 2023): Andres Alva and Andrés Chambouleyron consider key steps in calculating damages for a renewables project and discuss how delayed critical activities in procurement and construction must be identified, delay quantified and responsibility assigned.
- “Operational Risks” (December 2022): Peter Bird looks at the types of risks arising during the operational phase of infrastructure projects, affect potential disputes relating to the projects, and impact the organisations involved.
- “Construction Risks” (November 2022): Nelida Abi Saab, Pascale Leymin, and Seamus O’Doherty discuss risks that are prevalent during the construction phase of a project, risk management, and potential impacts of risk on disputes.
- “Financing and Allocation of Risks” (October 2022): Athanasia Arapogianni, Peter Bird, and Calvin Qiu discuss off-balance-sheet financing and the allocation of risks between different parties involved in a project.
Series 1
- “Disputes and Case Studies” (January 2022): Peter Bird and Calvin Qiu give an overview of the factors leading to infrastructure disputes, how these disputes arise and how project finance can affect the dynamics of disputes. They provide three case studies to show how these factors play out in real-world contexts.
- “Financing Strategies and Rate of Return” (December 2021): Calvin Qiu writes about how infrastructure projects are financed and how long-term investment decisions are made based on rate-of-return calculations.
- “Stakeholders” (November 2021): Peter Bird looks at the definition of an infrastructure project and provides an overview of the stakeholders involved.
